It observed that under Section 3(1) and Section 10(1) of the Act, a service is taxable only if it is provided in the course of an economic activity, as defined in Section 6(1)(b). This section covers the supply of movable or immovable property by way of lease or licence, but not through outright sale or transfer of ownership.<\/p>\n\n\n\n<p>The tribunal noted that treating the sale of developed plots as a taxable service would create a conflict between the charging provisions of the Act and its Second Schedule.
