What is purchase of plot file? How does it benefit the buyer of file and why does the seller sell it? Does it give the rights of physical possession to the buyer of file? I would be grateful if anyone sheds light on it in detail.

    A plot file is an allotte certificate given by housing societies that are currently in the development stage, once all the infrastructure has been put in place (street lighting, water, gas, electricity) and the area has been landscaped, then the housing authority will give posession to the owner/allottee of the plot file, which simply means you can construct a building on the plot.

    In relation to your second question, yes the purchase of a plot file gives you physical and legal posession of the plot.

      With due respect, I would like to disagree, any society that sells you a file gives you physical and legal possession of the plot/land. Legal and Physical possession is only available once the plot has been balloted, all dues have been clear and the plot exists on ground.

      Case 1 - All dues clear file: The customer has cleared all due and now the liability is on the society/developer to hand over the possession whenever the plot/land is ready for possession.

      Case 2 - File with down payment and installments: Down-payment must be made and installments must be paid and all dues clear in given time frame to get the possession of the plot.

      Case 3 - Plot 'File with Land': All dues clear file + some extra payment you can get a file that has 'File with Land' written means no matter what happens whenever the land is ready you are guaranteed to get it.

      No case gives you physical possession unless you have the plot on ground and ready for the possession. If you look at any files, you will see they have terms and conditions that say something like

      - 'Upon the receiving of full payments, Possession will be granted subject to clearance from XYZ.'

      - 'Society reserves the right to cancel any file/plot without prior notice however, clients amount will be refunded.'
